straight ahead on wavy news 10 midday - severe weather cleanup - our team of journalists will show you what's being done as people are picking up the pieces from this weeks tornado - and - how you can help. plus - tragedy in kansas - new information is coming out this morning about a shooting that killed four and hurt more than a dozen. as people in the area recall the chaos around them. (witness) "we was already looking at him and he yelled and just went doot..doot...doot and then entered the building." the new information released in an early morning news conference. and - deadly fire - the information we've uncovered about an early morning fire in norfolk. 10 on your side's liz kilmer will have a live report. we're following breaking news at this hour from newport news. today the family of man shot and killed by newport news police is learning if the shooting was justified. about an hour ago kawanza met with commonwealth's attorney howard gwynn who says that police didn't do anything

the shooting happened last july 4th. police got a call about a man in the east end of the city with a gun. we're told a detective along with a k-9 officer and a sergeant spotted beaty walking down a street. beaty was reportedly wearing a camouflage jacket and his arm was stiff. police say they tried talking with him but he started running. during the chase officers say they could see the gun and it appeared as if beaty pointed it one of officers. that's when officer randy gibson fired three times and hit beaty in the head. 10 on your side's jason commonwealth's attorney - we're hoping to have him live later in the newscast. to our other big story -- this midday -- storm cleanup from waverly. we have new video from the scene both on the ground and in the air. drone 10 was flying over the cleanup earlier today - showing the destruction left behind from the ef-1 tornado. which had winds of around 100 miles an hour. this is a story we've been following since those deadly storms pushed across the

it's really hard to grasp the mess left behind from the deadly tornado... so we want to show you new video from above the damage. you can see the path of destruction from drone 10. you're also able to see some of the cleanup that's already started. 10 on your side caught up with governor terry mcauliffe as he toured the area yesterday. he says he's made state resources available for cleanup efforts across virginia. the governor also visited tappahannock and appomattox county. four people in virginia died, including the 3 in waverly. we're learning more about the 3 people in waverly. 26-year-old devine house with his 2-year-old nephew, ian boyfriend, 50-year-old larry turner. they were in a mobile

none were hurt. but officials tell us -- a woman and two children on the second floor escaped through a window. hospital. again, an elderly woman was trapped, she suffered serious burns and did not survive. below, a couple duplex when the fire broke out. take a listen to what they experienced -- sot c49 sandra cahoon -victim for 12: 01:08:15 "engulfing, before we even opened the door the first time, our mini blinds in the window were melting inside, the flames hadn't gotten inside yet but it was bits of flames shooting down on us." sandra cahoon there and her husband made it out safely. her husband, without his shoes or jacket. both have minor burns but are overall, okay. their

family who lived above. they say the woman killed was a grandmother. we'll have more coming up on wavy news 10 at 12:30. meantime, the red cross is assisting -- firefighters are working to determine what caused the flames. live in norfolk, liz kilmer 10 on your side. a connecticut judge has ordered a probable cause hearing for a convicted killer from hampton who is charged for killing six people. the hearing for william devin howell is may 11th. people charged with murder in connecticut have the right to a probable cause hearing at which prosecutors have to show there is enough evidence to continue to trial. police allege howell killed six women and a man in 2003 and dumped the bodies behind a connecticut shopping center. he's already serving 15 years in prison for manslaughter in one killing and faces other six. still ahead - gop debate - we'll show you what

governor terry mcauliffe says virginia faces "somewhat of a crisis" over a lack of lethal-injection drugs for a scheduled execution next month. state officials are frantically searching for the drugs for the march 16 execution of convicted killer ricky gray, one of the state's seven remaining death row inmates. the state has two vials of pentobarbital it received from texas last year. mcauliffe

to test one vial and have another as a backup before it can proceed with an execution. the general assembly is currently considering a bill to allow the state to use the electric chair as an alternative to legal-injection drugs. we want to get you caught up on developing news out of kansas where authorities say 4 people died and more than a dozen were hurt in a workplace shooting yesterday. the victim's families identified the shooter as cedric ford. they say he was a coworker of the victims. investigators say say the shooter himself is also dead. officers held a press conference within the last two hours about the deadly shooting that happened the city of hesston, which is about 20 miles north of wichita. investigators say there were four separate crime scenes - they also say the gunman was upset when he received protection order at work an hour and a half before the shootings. officials say the gunman worked at excel industries plant, a company that makes lawn care products and riding lawn- mowers. virginia beach police

an armed robbery at at&t. it happened at the store on virginia beach boulevard just after 8:30 last night. police say two men went into the store with a gun, demanding phones. nobody was hurt. if you have any information - call the crime line. a building has quite a bit of damage after a car drove through it overnight. take a look at these pictures sent to us from chesapeake city officials. we're told a car lost control on canal drive and hit the side of the building. the fire department did not condemn the building. also - there are no charges or injuries. it was a night of fireworks at the gop debate in houston. the five republicans who want to be the next president squared off in a heated discussion. marco rubio threw the first punch, challenging front-runner donald trump on immigration. ted cruz came out swinging as well. rubio and cruz are battling it out for second place. and it didn't take long

here locally - the budget proposal that includes 175- thousand dollars more over the next two years to cover a bigger per diem for senators. both the house and senate passed their respective versions of their 100-billion dollar biennial budgets thursday. increase is reasonable because it would help offset citizen legislator. freshman g-o-p senator david suetterlein say such lawmakers should not be for themselves. republican lawmakers and advocates are hoping democratic governor terry mcauliffe has a change of heart and signs legislation to allow home-schooled students to participate in public- school sports. rob bell appealed thursday to home- schoolers around the state to write letters to mcauliffe asking him to approve the so-called "tebow bill," named for tim tebow, the former nfl quarterback who was home-schooled and allowed to play football for his local high school. a similar version of the legislation has

beat out its fast-food rivals to become the first major chain to make the change in all the antibiotic-free rotisserie-style chicken sandwich will be available on march first. mcdonald's announced a similar still working on implementation. chick-fil-a says it has now reached 23 percent of its goal to eliminate with full conversion expected by 20-19. many fast food companies have committed in recent years to selling "cleaner" ingredients. that's due in part to warnings about antibiotics in food. wal-mart faces a lawsuit over its "great value" brand grated parmesan cheese. a man filed the suit claiming he spent more money for the "100 percent grated parmesan cheese" because he believed it was 100 percent pure. according to the complaint, the product contains seven to 10 percent of cellulose, which is a filler derived from wood pulp. the man accused walmart of deceptive business practices. coming up on midday--

mcginley arrived on scene - he used his baton to break out the passenger side window of the wrecked and burning chevy suburban he then opened the door and with the help of another person, pulled the 29-year-old driver to safety. the driver suffered minor injuries in the incident. new information this midday about bill cosby's defamation lawsuit. we've learned the comedian has dropped the lawsuit against supermodel beverly johnson. cosby's lawyers say they dropped the civil suit because in their words..... criminal proceedings in pennsylvania impede mr. cosby's ability to fully participate in litigating the civil case against ms. johnson. they say they plan to re-file the civil case against johnson before the statue of limitations expire. in her memoir, johnson accuses cosby of drugging her and trying to rape her without success at his home in the 1980's. so far no reaction from johnson on cosby's decision.
